Indiana
DUI - Get Help
A very important
piece of information you should remember if you are arrested for
a DUI is to not feel like you are all alone in this. So many people
let the anxiety and nerves just tear them apart between their
arrest and court date. Getting nervous and upset over something
that has already happened will not get you anywhere, and certainly
will not make you feel any better about the situation. Now doing
something to help the situation, that's something worth thinking
about.
The
Truth about Lawyers
- Even though lawyers are the brunt of a lot of jokes out there,
they really are in the legal industry to help you. You could hire
one of the most expensive lawyers out there to represent you for
your DUI case, and you will still pay less money to him than you
would to the court system. If you had the option to pay a certain
amount of money to the court, have your license taken away, have
to go to jail and spend a weekend at a conference where they describe
to you how bad drinking and driving is... OR, pay a lawyer a smaller
amount of money, have a good chance of keeping your license, have
a better chance of having the DUI dropped and to stay out of jail,
wouldn't that be better?
Frequently
Asked Questions
I
lost my license because of a DUI, what's the easiest way to still
be able to purchase alcohol or goto clubs that would require to
see my license?
After your
DUI is processed and your license is officially suspended through
the BMV, you can apply for a Indiana State Identification Card. It'll
be state-issued and has your birthdate on there that you can use
to do anything that requires age verification.
I
was just arrested for a DUI, how much is this going to cost me?
The Court
fines are listed on the Indiana
DUI Laws page, but you'll also have to take into
account that there are reinstatement fees to get your license
back, there are fees for the Alcohol Counseling Programs that
they sometimes require, car impoundment fees, special plate fees,
etc.
If
I'm arrested for DUI, is it better to refuse the breathilizer
test or to actually take it?
By refusing
to take the test, you are in the position to lose your license
for 12 months instead of just 6 months, plus, even if your DUI
case is dropped, the refusal for the test might not be, so it's
definitely a risk. By taking the test, you have provided more
evidence to the court system to use against you during your case,
but also will get your license back 6 months sooner.
I
am 20 years old and was arrested for a DUI even though I
only had a .06 on my BAC test, can I fight that since I wasn't
at .08?
First of all,
the .08 BAC amount is only there as the maximum number allowed
by the law. You can be arrested for a DUI with a lower number
if the officer believes that you were in fact too impaired too
safely operate the motor vehicle. However, since the drinking
age in Indiana is 21, if you were picked up with ANY amount of alcohol
in your system being under-age, you will be charged.
